TERMS OF PURCHASE

1. INFORMATION ABOUT US
www.so-yeon.com is provided to you by So yeon Kim (“us”, “we” , “our”, the “Vendor”).

2. PLACING ORDERS
2.1) You may only place orders from us if : (a) you are over 18 years old, (b) possess a valid debit or credit card (or are authorised to pay via another of our accepted methods of payment), and (c) are able to accept delivery at the time of your purchase, in the following countries : Austria, Belgium, Bulgaria, Croatia, Cyprus, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, The Netherlands, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden, Switzerland, UK, US, South Korea, Japan, and/or other countries as are listed on our website from time to time as a delivery address (“Approved Delivery Location”).
2.2) You may only place an order for products via our website.
2.3) When placing an order, please ensure you provide complete and accurate information. Information we may require include your first name, surname, phone number, email address, delivery and invoicing addresses. We may also ask for additional information during the ordering process to validate your order. It is your responsibility to ensure that the order is correct and accurately reflects your selection.
2.4) The order shall be deemed to have been submitted when we receive your order form electronically and the order information has been verified as correct.
2.5) The order form will be filed in our database for the time required to process your order and as provided by law.
2.6) After your order form has been submitted, we will process your order.
2.7) We may refuse to process purchases if there are no sufficient guarantees of solvency, when orders are incomplete or incorrect, or the products are unexpectedly out of stock, or you are located outside an approved delivery location, or we suspect you have, breached these terms. When this happens, we will let you know as soon as possible, and we will not charge you for your order.
2.8) We will communicate acceptance of your order by sending you an email (“Confirmation”) at which point a contract will come into existence between you and us.
2.9) If you place an order for multiple products and some of those products are unavailable, we may process the order in respect of the available products.
3.0) If you discover that you have made a mistake with your order or wish to cancel it before we have sent you the confirmation, please notify us immediately by sending us an email  so-yeon@so-yeon.com . If you discover that you have made a mistake with your order or wish to cancel it after we have sent you the confirmation, then please note that we are generally unable to rectify mistakes or cancel your order while processing the shipment, although you may still have the right to return your products and receive a refund as described in clause 6.

3. PAYMENT TERMS
3.1 Prices are subject to change. Please check the final price of sale before sending the relevant order form. The prices for the products shall be as quoted on the website from time to time, except where there is an apparent error. In the event of a recognisable error in the indication by the Vendor of the product price or calculation of the amount requested at payment, the Vendor will reject the order and contact the user to offer them the opportunity to purchase the product(s) at the correct price or to cancel the order. If we are unable to contact you, the order will be treated as cancelled. Prices do not include any customs, and import duties, which will be added at checkout (if applicable).
3.2 All prices include any applicable VAT. Please note that all orders delivered to the US, import taxes and custom duties are not included in the total price of your order and are the sole responsibility of the customer. By placing an order, you agree to cover any additional costs that may be imposed by customs upon arrival in the US.
3.3 We will only take payment once the order has been accepted by us (at the time of sending you a confirmation).
3.4 Payment of the price of the products, shipping and delivery costs must be made using one of the methods indicated on the order form. Shipping and delivery costs are non-refundable.

4. SHIPPING AND DELIVERY
4.1 We only deliver products to an approved delivery location. For the avoidance of doubt, we do not deliver to freight forwarders, lockers, depots, PO Boxes, or any other similar type of third-party agent or address.
4.2 We will arrange for delivery of the products using our chosen delivery courier. We aim to deliver products to you as soon as we can and will provide you with an estimated delivery date as part of your confirmation. Delivery dates indicated in any order form or order confirmation are estimates only and shall not be deemed a representation by the Vendor. The Vendor will not be liable for failure to ship or deliver the products as estimated, and you will not be entitled to any refunds or cancellation of orders as a result of delayed shipment.
4.3. All products are delivered using a tracked and signed service. Please note that it will not be possible to remove the need for a signature or redirect delivery to another address, safe place or person. Please note that whilst a signature will be required for your delivery, we are not in a position to verify signature, so would advise you to sign for your order yourself and to not delegate this to a third-party on your behalf. We will not be liable for any loss or damage to products which are not signed for by you.
4.4 Risk of any damage to or loss of the products shall pass to you at the time of delivery.
4.5 If no one is available at your address to take delivery, our relevant delivery courier company may attempt to redeliver the products and/or leave a note explaining that the products have been returned to the depot, in which case, you will need to collect the products. Please use the contact details provided by our delivery company to arrange this collection.

5. PRODUCTS
5.1 The images of the products on our website are for illustrative purpose only and may not correspond exactly to the actual appearance, size and colour of the products.  Although we have made every effort to display the colours and materials accurately, we cannot guarantee that the display of the colours or materials on your computer or device accurately reflects the true colour or material of the products.
5.2 The Vendor reserves the right to modify or discontinue any product offered for sale on the Website at any time without notice.
5.3 The packaging of the products may vary from time to time.
5.4 Any products purchased must not be resold or made available for resale on a commercial basis, which includes, but is not limited to, making them available on resale sites, as well as any attempts to purchase items on a wholesale basis. All products should be bought for personal use only and not for commercial activity.

6. RETURN CONDITIONS
6.1 You have the right to return products purchased on www.so-yeon.com (the “Website”)  by notifying So yeon Kim (the “Vendor”) within 14 days from the day you receive the products.
Once you have exercised your right of return in accordance with the procedures set forth below, the product to be returned must be handed over to the courier in one single shipment within 14 days of from the day you receive the products.
6.2 The Vendor only accepts returns of products within the time frames set forth above, and will reimburse the purchase price of the products (minus shipping fees, as applicable) only if the following conditions have been met :
a) The products have not been used, worn or washed and are in the same conditions in which they were received ;
b) The identification tag (with the disposable seal) and labels are still attached to the products ;
c) The products are returned in their original packaging ; and
d) The products are not damaged.
You cannot return customised or personalised products, or sealed items that were opened after delivery and that cannot be returned due to health or hygiene reasons. Swimwear, undergarments cannot be returned.
6.3 You must inform the Vendor of your intention to return products by sending an email to so-yeon@so-yeon.com. Upon receipt of the notice of withdrawal, the Vendor will communicate the methods for returning the products by email. The shipping costs and any custom duties and taxes  for returning the products are charged to the customer.
6.4 Our products must be returned in a new and unused state, in perfect condition, with all protective materials in place and tags and stickers attached to them (if applicable), including all accessories, packaging and documents. We reserve our right not to accept any return if the product shows signs of wear or has been used or altered from its original condition.
6.5 If the return conditions are met, you will receive an email confirming that the return has been accepted and the Vendor will refund the purchase price of the returned products (minus shipping fees, as applicable). Refunds are processed within approximately between 7 to 10 business days of our receipt of the returned products and confirmation that the return conditions have been satisfied. Your refund will be credited back using the same payment method used to make the original purchase on the Website.
6.6 You have the right to return products purchased on www.so-yeon.com (the “Website”) due to an error on our part or because product(s) are damaged or defective, provided that you notify the Vendor immediately within 7 days of receipt of the product(s), by sending email to so-yeon@so-yeon.com You must return the product(s) by mail in the same condition in which they were received, unused, unworn and unwashed, in their original packaging and with their identification tag attached with the disposal seal. The vendor will examine the returned product(s) to determine whether they are damaged, defective or incorrect, and will inform you by email within a reasonable period of time of whether the Vendor will accept the returned product(s) and refund their price. If accepted by the Vendor, damaged, defective or incorrect product(s) will be refunded in full to your original method of payment, including applicable taxes and delivery shipping cost. In the event that the Vendor finds no damage, defect or error with the returned product(s), you will be notified that the refund will not be processed, and your merchandise will be shipped back to you. If you refuse the delivery the Vendor reserves the right to retain the product(s) and the amount paid for the purchase of the product(s).
6.7 Products may be exchanged only for a different size and/or colour of the same model, provided the following conditions are met, and subject to product availability by sending an email to the Vendor within 14 days after receipt of the product(s) :
a)The products have not been used, worn or washed and are in the same conditions in which they were received ;
b)The identification tag (with the disposable seal) and labels are still attached to the products ;
c)The products are returned in their original packaging ; and
d)The products are not damaged.
If you have not met the exchange conditions, the Vendor will notify you by email that the exchange will not be processed, and your merchandise will be shipped back to you. If you refuse the delivery the Vendor reserves the right to retain the product(s) and the amount paid for the purchase of the product(s).
6.8 For returning and exchanging the product(s), customs and import duties, and delivery shipping costs are charged to you and will not be refunded.

7. MADE-TO-ORDER PRODUCTS
7.1 The Vendor may offer you the opportunity to purchase one or more made-to-order products from current or past collections. Products available as made-to-order will be clearly labelled on the product page. For each item, the Vendor will indicate the estimated shipping date and will send you an email updates regarding the production status, as well as a confirmation email once the package has been shipped. If your order contains both ready-to-ship products and made-to-order products, they will be shipped at different times, but the respective shipping costs will be charged only once. If your order contains multiple made-to-order products with different estimated shipping dates, all products may be shipped all together on the latest estimated shipping date.
7.2 All made-to-orders require full payment at the time of purchase. This ensures your order is secured and prioritised in our production schedule.
7.3 Made-to-order items have an estimated shipping timeframe stated on the product page. Please note that these are approximate dates and may be subject to change due to production or supply chain factors. 
7.4 Orders for made-to-order items may be cancelled within 2 hours of placing the order. After this period, production begins and the order can no longer be cancelled or modified. Please review your order carefully before completing your purchase. 
7.5 Made-to-order items are not eligible for refunds, returns, or exchanges under our standard return policy, except in the case of defects or non-conformity. Refunds will not be issued due to delays in the estimated shipping timeframe.
7.6 By placing a made-to-order purchase, you acknowledge and accept the above terms.

 

8. FORCE MAJEURE
The Vendor shall not be liable for any delay or failure in performance caused by circumstances beyond its reasonable control.

9. ERRORS AND INACCURACIES
Our goal is to provide complete, accurate, and up-to-date information on the Website. Unfortunately, it is not possible to ensure that any website is completely free of human or technological errors. The Website may contain typographical mistakes, inaccuracies, or omissions, some of which may relate to pricing and availability, and product information. We reserve the right to correct any errors, inaccuracies or omissions, including after an order has been submitted and you have received the email confirming receipt of the order, and to change or update information at any time without prior notice.

10. AMENDMENTS AND UPDATES
The Vendor may amend or update all or any part of this terms of purchase at any time in its sole discretion and without notice. Any amendments and updates to the terms of purchase shall be effective upon publication on the Website. If any provision of any part of this terms of purchase shall be deemed invalid, void or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining terms of purchase.
